Agreement
These Terms of Service (“Terms”) govern your access to the Within health dashboard at health.crob.ca (the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
“Within,” “we,” “us,” and “our” refer to the operator of the Service. “You” refers to the person using the Service.
Eligibility and access
You must be at least 18 years old and legally capable of entering into these Terms. You may use the Service only with an Oura account and data that belong to you or that you are expressly authorized to access.
You are responsible for protecting your Oura account, authorization credentials, and devices. Notify us and revoke the Service’s Oura access promptly if you suspect unauthorized use.
The Service
The Service requests information you authorize through the Oura API and presents selected sleep, readiness, activity, and related wellness metrics in a personal dashboard. You grant us permission to process that information solely to operate the Service as described in our Privacy Policy.
The Service is independent from Oura. Oura does not sponsor, endorse, or control Within, and Within does not replace the Oura application or any Oura service.
Health disclaimer
Scores, summaries, trends, and other content are provided for general informational purposes only. They are not medical advice, diagnosis, treatment, monitoring, or an emergency service.
Do not disregard professional medical advice or delay seeking care because of anything shown by the Service. Consult a qualified healthcare professional about health decisions. If you believe you are experiencing an emergency, contact local emergency services immediately.
Acceptable use
You agree not to:
- access another person’s data without clear authorization;
- use the Service for unlawful, fraudulent, harmful, or abusive purposes;
- probe, disrupt, overload, bypass, or compromise security or access controls;
- scrape, harvest, reverse engineer, or systematically extract the Service or Oura data;
- resell, redistribute, publish, or commercially exploit data obtained through the Service;
- use Oura data for advertising, profiling, data brokerage, or artificial intelligence training; or
- misrepresent an affiliation with Within or Oura.
Third-party services
The Service depends on third parties, including Oura, WorkOS, Convex, and Vercel. Your use of their products may be governed by separate terms and privacy policies. We are not responsible for third-party products, data accuracy, outages, policy changes, or acts outside our control.
You must maintain any Oura membership, device, consent, and permissions needed for the data you wish to view. Oura may change, limit, suspend, or discontinue API access at any time.
Ownership
Within retains all rights in the Service’s original software, design, branding, and content. Oura and its licensors retain all rights in Oura, the Oura API, Oura data, scores, metrics, trademarks, and related intellectual property. These Terms do not transfer ownership of your personal information to us.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, and non-transferable right to use the Service for your own non-commercial wellness review.
Availability and changes
We may change, suspend, or discontinue any part of the Service, including supported metrics, at any time. We do not promise uninterrupted availability, a particular feature set, or that Oura information will always be current, complete, or error-free. Data availability depends on your ring, synchronization, Oura’s processing, your permissions, and third-party systems.
Disclaimers and liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or collateral, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
To the fullest extent permitted by law, Within and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, opportunity, goodwill, or profits; or health decisions made in reliance on the Service. Nothing in these Terms excludes liability that cannot legally be excluded or limits your non-waivable consumer rights.
Termination
You may stop using the Service and revoke Oura access at any time. We may suspend or terminate access if you breach these Terms, create security or legal risk, misuse Oura data, or if continued operation is no longer reasonably possible. Provisions that by their nature should survive termination will survive.
General terms
These Terms and the Privacy Policy are the entire agreement concerning the Service. If a provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a change in responsibility for the Service.
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere.
We may update these Terms as the Service or law changes. Continued use after revised Terms take effect means you accept them. If a change materially affects your rights, we will provide reasonable notice where practicable.
